Metuh’s trial: Court admits witness’ degree certificate as evidence

– The degree certificate of Collins Ifeanyi, a consultant with Q-time Nigeria limited has been tendered before the Federal High Court in Abuja

– Ifeanyi who studied political science at a university in United States of America is the second defense witness in the trial of Olisa Metuh

A Federal High Court in Abuja on Tuesday, May 17, admitted the degree certificate of the second defense witness, Collins Ifeanyi as evidence.

Ifeanyi is a consultant with Q-time Nigeria limited, a resource management and public relations company.

He studied political science at a university in United States of America.

The defense counsel, Emeka Etiaba had prayed the court to admit a photocopy of the certificate.

But the prosecution counsel, Sylvanus Tahir in his objection said that a photocopy of the document cannot be admissible because the certificate is a public document.

However, in his reply, Etiaba said Tahir’s objection was not in order.

He argued that the degree certificate of Ifeanyi is a private document.

Supported by the second defendant’s counsel, Tochukwu Onwubufor, Etiaba added: “What the witness has tendered is his personal certificate issued to him by his Alma mater, my lord, there is not a public document and does not come under the purview of Section 102 of the Evidence Act,” Etiaba said.

However, in his ruling, the judge, Okon Abang said he agrees with the first defendant’s counsel that the document is not a public document.

But Abang said he disagrees that the document be substituted with a photocopy.

Once a document is submitted to the court, it is left in until 90 days after the matter is disposed without an appeal.
