Tengrinews.kz – The mother of an injured child has filed a lawsuit against a dental clinic.
The Supreme Court's press service shared the story of a family from Kyzylorda who took legal action against dentists.
“A resident of Kyzylorda sought treatment at a pediatric dental clinic due to a dental issue with her child. After the treatment and extraction of a tooth, the child's jaw swelled the next day, and his health condition worsened,” the statement said.
The child was diagnosed with “acute purulent odontogenic phlegmon of the left lower jaw, post-extraction of tooth 7.5.” Two surgeries were performed.
Six months later, the jaw swelled again, and pus accumulated. The third operation was paid for.
“According to the findings of the medical and pharmaceutical control department's inspection, the clinic's dentist did not adhere to clinical protocols for diagnosis and treatment during the child's medical care,” the court reported.
It was revealed that the tooth was removed by a dental assistant with a mid-level medical education, without examination or X-rays of the jaw. In her lawsuit, the Kyzylorda resident claimed that due to negligence, the child's condition worsened, he was unable to sleep for nearly 2 years, and was diagnosed with a disability by doctors.
She demanded that the clinic compensate her family for both material and moral damages.
The court ordered the dental clinic to pay more than 1.5 million tenge in compensation for moral and material damages.
