Sydney-based wedding dress designer 10 Foster Street needs to pay $51,604 in penalty and back pay entitlements after failing to act on Fair Work Ombudsman’s (FWO) compliance notices.
The Federal Circuit and Family Court imposed a $30,000 penalty against 10 Foster Street – formerly trading as George Elsissa – and ordered it to pay back pay the workers $21,604, plus superannuation and interest.
The case concerns four former workers employed in various periods between June 2015 and September 2021.
The FWO said that 10 Foster Street did not pay the workers accrued but untaken annual leave employments at the end of their employment.
One of the workers did not also receive payment-in-lieu-of-notice-of-termination entitlements when her employment concluded.
“When compliance notices are not followed, we will continue to take legal action to protect employees. Employers who fail to act on these notices risk significant penalties and back-pay orders,” said Anna Booth, Fair Work Ombudsman.
