WEST STOCKBRIDGE, Mass. (NEWS10)-- A man pleaded guilty and was sentenced for a motor vehicular homicide on the Massachusetts Turnpike in April 2023. Gilberto Franciapena, the driver, was sentenced to two years of probation and lost his driver's license for 15 years.
According to the Berkshire District Attorney's Office, on April 20, 2023, Franciapena and four others were heading eastbound on the Massachusetts Turnpike when their car flipped. Four people, including Franciapena, were transported to the Berkshire Medical Center.
One person was pronounced dead at the scene of the crash. The Berkshire District Attorney's Office said Franciapena was not impaired during the crash.
He was also sentenced to 100 hours of community service. The Commonwealth requested a two-year suspended sentence and a loss of license for 15 years.
Assistant District Attorney Johnathen Moffat represented the Commonwealth. Tara Jones-Nutting served as a victim witness advocate on behalf of the Berkshire District Attorney’s Office.
