Fox News legal analyst pours cold water on GOP plans to impeach Biden official

This Sunday, House Republicans released two articles of impeachment against Homeland Security Secretary Alejandro Mayorkas, accusing him of "willful and systemic refusal to comply with the law" and "breach of public trust," according to reports.

In a statement, House Homeland Security Chairman Mark Green (R-TN) said the articles "lay out a clear, compelling, and irrefutable case for Secretary Alejandro Mayorkas' impeachment," and added that Mayorkas "has willfully and systemically refused to comply with immigration laws enacted by Congress. He has breached the public trust by knowingly making false statements to Congress and the American people, and obstructing congressional oversight of his department."

During an appearance on Fox News, legal commentator Jonathan Turley said that if the House has a basis for impeachment, they have an obligation to proceed.

However, he then poured cold water on the GOP's efforts.

"I just don't believe they have a cognizable basis here for impeachment," Turley said.

"The first article is basically a disagreement about the level of enforcement being done by the administration," he continued. "The Republicans are right -- we have an open border, this is a huge crisis, but that is a policy judgement made by the president. The courts have said a president can give priority in the enforcement of federal laws, and this is not the first president who's been challenged over lack of enforcement at the border."

Nevertheless, Green said on Sunday that Mayorkas needs to be held accountable.

"The results of his lawless behavior have been disastrous for our country," Green said. "Empowered and enriched cartels, mass fentanyl poisonings, surges of terror watchlist suspects, more criminal illegal aliens causing harm in our communities, and traumatized and exploited migrants will be Secretary Mayorkas' open-borders legacy."
