Restaurant sued for ‘over-serving’ drinker who then ‘drove drunk and killed woman’
A restaurant has been sued for allegedly over-serving a customer who killed a woman in a drink driving crash and gravely wounded her boyfriend.
The boyfriend, Luis Ramirez, has filed a lawsuit against World of Beer in Cypress, Texas, for serving Zachary Castro six beers and four shots on the night of the smash.
It killed Ramirez’s girlfriend Mayra Ospina on January 27, after the couple pulled over to check a disabled car.
Ramirez said: ‘The survivor’s guilt is consuming me. All we were trying to do is make sure someone was okay.
‘I look over and see bright lights coming really, really fast.
‘I was able to say, “Watch out!” and I woke up in the hospital Monday morning.’
The survivor’s lawyer Joe Stephens says World of Beer is liable for negligence because Castro also worked there.
One in seven people have had something stolen from them by a colleague at workHe told KTRK: ‘They should have cut him off and, as a bar and as a friend to the bar manager, they should have called up Uber and sent him home.
‘This would have never happened.’
Castro has since been fired fro his job, and has been charged with intoxication manslaughter as well as intoxication assault.
Ramirez’s lawsuit against his former employer seeks undisclosed damages for medical expenses, lost wages, physical pain, suffering and mental anguish.
The grieving boyfriend, who spent three weeks in hospital and is still recovering from his injuries, added: ‘Think about what you over-serving a person could do.’
A World of Beer spokesman said: ‘We’re deeply saddened by the tragic event. Our thoughts and prayers are with the victims and their families.
‘We are cooperating with authorities and providing all requested information.
‘We cannot comment further on pending litigation.’
