Woman Sues Doctor Who Gave Her Drugs Without Her Consent, Killing Her Unborn Baby

A New Mexico woman is accusing a hospital of medical malpractice that led to her unborn baby’s abortion death.

The lawsuit filed by Marlina Romero against Lovelace Health System in Albuquerque and Dr. Kristina Chongsiriwatana recently moved forward after a court ruling about the timing of its filing, KRQE Media reports.

According to the lawsuit, Romero went to the hospital in June 2011 after experiencing a sharp pain in the lower left part of her abdomen, the Santa Fe New Mexican reports. Tests revealed that she was about four-weeks pregnant, according to the lawsuit.

Later, however, a doctor said ultrasound scans showed signs of an ectopic pregnancy, which can be life threatening, and an ovarian cyst, the lawsuit contends.

Chongsiriwatana, at Lovelace, found no such pregnancy and drained the cyst, the suit says.

“Despite having discovered no visible evidence of an ectopic pregnancy, Dr. Chongsiriwatana treated (Romero) with methotrexate, which carries a high risk for birth defects,” the suit says, adding Romero, who had been anesthetized, could not consent to the treatment at the time. …

Six days later, Romero returned to Chongsiriwatana still in pain. After an ultrasound, her suit says, Chongsiriwatana told Romero she had a normal pregnancy and should not have been given methotrexate, and that Romero “must abort it due to possible birth defects.”

Apparently thinking she had no other option, the woman went through with the abortion, though she did not want it.

Her lawsuit currently is in front of a New Mexico district court.

In a similar case filed earlier this year in California, another woman alleged that her her doctor mistakenly prescribed her abortion drugs that killed her unborn baby.
