Obama-appointed Judge Amy Berman Jackson on Tuesday dismissed one of two counts federal prosecutors filed against Obama’s former White House counsel Greg Craig just days before his trial is scheduled to begin.
Craig’s legal counsel filed two motions to dismiss, one for each count in the indictment.
In a 57-page memorandum written on Tuesday, Judge Jackson dismissed the second count.
With respect to Count Two, while the Court can fairly square the plain language of 22 U.S.C. § 618, FARA’s false statement provision, with the government’s application of that provision to the October 11, 2013 letter the defendant submitted to the Department of Justice FARA Unit “Re: FARA Registration,” it finds, after application of the full range of tools of statutory construction, including an analysis of the statute as a whole, that the legislature’s clear intent cannot be discerned. Given this ambiguity concerning the breadth of the provision and the documents to which it was intended to apply, the rule of lenity requires the dismissal of the count.
Former Obama White House Counsel Greg Craig was indicted by a federal grand jury in April on charges stemming from Mueller’s probe related to work he did for Ukraine in 2012.
Craig, 74, served as legal counsel for Obama from 2009 to 2010 and worked as senior legal counsel to Bill Clinton during his impeachment.
A federal grand jury returned a two-count indictment on April 11 on charges of making false statements and concealing information about his Ukrainian lobbying efforts.

Greg Craig worked with Paul Manafort, but since he’s a long time Clinton-Obama fixer, the media ignored the story and now one of Obama’s corrupt judges decided to dismiss one of the counts filed against him.
Craig’s trial is scheduled to begin on Monday.
